Is videotaping legal with your DIY Dascham (Insurance/Police)?
In the last year I’ve purchased a flash-based Video camera and have used small adhesive brackets to mount it to my dashboard. Its not concealed in any way and is easily identified as such.
Is it okay for me to record myself and others on the road, and even use the video for insurance claims or to contest traffic tickets? The camera “can” also record audio, and would pick up whatever an officer would say if he were at the driver’s side window.
As an attorney, I’m almost certain that it’s legal. You would have to check your state laws to be sure, but I’ve never heard of a crime for videotaping in public (which is what you’re doing). The only real concern I can think of is whether it obstructs your view while driving, in which case it’s possible for the officer to hit you with a traffic ticket for having an obstructed view…but even that could probably be well-defended in court.
